Terms and conditions

These terms govern your use of archerautomation.ai (the “site”), operated by Archer Automated Solutions (“Archer Automation,” “I,” “me”), a sole proprietorship based in Granby, Massachusetts. By using the site you agree to them. If you do not agree, please do not use the site.

The site is information, not a contract

Everything on this site, including prices, timeframes, and descriptions of services, is a general description of what I offer. It is not an offer that becomes a contract when you accept it, and it is not advice for your specific situation. Actual work is done under a separate written agreement (a proposal, statement of work, or engagement letter) that sets out the scope, price, schedule, and terms for that project. If that agreement and these terms ever conflict, the signed agreement wins.

Prices and availability

Prices shown are starting points in U.S. dollars and may change without notice. A quote I give you in writing is good for the period stated in it. I may decline any project for any lawful reason.

Using the site

• You may use the site for lawful purposes only.
• Do not try to break, probe, scrape, overload, or gain unauthorized access to the site or its hosting.
• Do not submit false information through the contact form or use it to send spam.
• You are responsible for anything you submit and confirm you have the right to submit it.

Content and ownership

The text, design, code, and graphics on this site belong to me or are used with permission, and are protected by copyright and other laws. You may view and print pages for your own reference. You may not copy, republish, or use them commercially without written permission. Client names and work shown on the site appear with the client’s consent; those businesses own their own names and marks.

Third-party links and services

The site links to other websites and uses third-party services for things like scheduling and email. I do not control those sites or services and am not responsible for their content, availability, or terms. Your use of them is governed by their own terms and privacy policies.

No warranties

The site is provided “as is” and “as available.” I work to keep it accurate and running, but I make no warranty that it will be error-free, uninterrupted, or free of harmful components, and I disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose, to the fullest extent the law allows. Nothing on the site is a guarantee of any result for your business.

Limitation of liability

To the fullest extent permitted by law, I am not liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of or inability to use the site, even if I have been advised of the possibility. My total liability for any claim relating to the site will not exceed one hundred U.S. dollars ($100). Liability for services performed under a signed agreement is governed by that agreement. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnity

You agree to defend and hold me harmless from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the site or your violation of these terms or the law.

Privacy

How I handle personal information is described in the privacy policy, which is part of these terms.

Governing law and disputes

These terms are governed by the laws of the Commonwealth of Massachusetts and applicable federal law, without regard to conflict-of-law rules. Any dispute relating to the site will be brought in the state or federal courts located in Hampshire County or Hampden County, Massachusetts, and you consent to their jurisdiction. Before filing anything, you agree to email me and give me thirty days to try to resolve the problem directly.

Changes and the rest

I may update these terms; the date at the top will change when I do, and continued use of the site means you accept the update. If any part of these terms is found unenforceable, the rest still applies. These terms, together with the privacy policy, are the entire agreement between us about the site itself.
